Depends on what state. In California, if you harvest deer with out a deer tag, you can go to jail. In Texas, you can set up a stand on your own property, and harvest as many deer as you like during deer season.

i imagine this is a bigger issue in a large commercial setting. i know one family with a small commercial sheep outfit who seem fully normal and grounded. more like old fashioned farmer types. animals aren't in automated penstocks or anything though, and their facilities were mostly built 50+ years ago. First thing you need to do is post your land. The guy will just say he thought he was on someone else's land. If it's posted and he is still using the stand then you can show intent to trespass and poach.
Try to find where he is coming on to your property. Look for parked vehicles nearby. Unless you have a live feed of that stand, it will be easier to catch him that way.
