Looking at the cigarette more closely - the timing of when this body is found. First if it was within minutes. You should see the smoke trailing away from the cigarette. If it was found hours later. Then we should see the cigarette much smaller and only see the butt of the cigarette.

1. The pen was laid down while writing. The natural position of the pen laying down is how it would be laid down if writing with the right hand.

I worked this case. It was in fact a suicide.
Victim was left handed, wrote note and was smoking a cigarette, waiting for her husband to come home from work. Victim has also been drinking, evidenced from empty wine bottle in garbage. Victim had just found out her husband was cheating on her with her best friend.
Husband states when he opened the apartment door, victim was sitting on the stool with her back to the window facing the doorway he just entered. Victim pointed the gun at her right temple, stated "I hope you're happy with your whore!", and pulled the trigger.
Victims prints found on weapon, bullet casings. Victims hand tested positive for gun shot residue. Husband tested negative for gun shot residue on the hands and clothing he was wearing.
Case closed.
