For a legal investigation into material like emails on a laptop, there must be a warrant form a judge. That doesn't mean they haven't seen the material, it means it cannot be used in the investigation until there was legal authorization. In the course of the investigation into Weiner's dealing with underage girls, they did read a lot of those emails. They knew the content.
