Most damning of all is the pen. The gun implies the victim is right handed, but the location of the pen in relation to the suicide note would indicate they were left handed.
We could be dealing with a serial killer, as only the right flip flop is present. The left flip flop must have been taken as a trophy. The rest of the room is too neat to imply one strayed from the other to such an extent. In fact, it's likely that the victim was wearing their flip flops at the time of the murder.

I want to say neither because of the placement of everything. The case is a shooting hence the gun being present in the "victim's" hand. The position of the body, chair, shell casing and blood splatter are rather inconsistent for it to be labeled as a pure suicide but I can't make a correct judgement since I can't see the victim's face. The placement of the gun,shell and blood are making me really rethink the suicide label because the casing is on the counter, the blood is directly behind the victim and the way the victim is holding the gun don't add up. However, I don't know the reasoning besides the papers on the table. There isn't enough information to draw a conclusion. There are only a few things I notice that lend any real evidence to either side.
1. There's blood splatter on the wall but no visible bullet hole. If the person was shot in the head and that was what caused the splatter then there would be an entrance and exit wound and the bullet should have hit the wall and made a hole. There is no hole.
2. There is no bullet casing on the floor. Perhaps it's under the person's body or fell somewhere else and is not visible. No conclusions can be made there.
3. The person is still holding their cigarette. If another party was involved it is likely the cigarette would have been dropped instead of being held on to.
4. There appears to be a written note on the desk which could be a suicide note. Then again, it could be a poem about how much this person loved life.

My guess would be that this is a suicide. The person wrote a suicide note, turned around in there chair to take one final look at his/her surroundings, took a final drag off their cigarette, and then shot him/herself in the right side of their head which caused the bullet to exit the left side of their head and make the splatter on the wall as well as cause the body to fall to the left, from the person's perspective. The splatter would also be at level with their head if the person was seated which means the trajectory of the bullet, the head, and the splatter would all line up. Had the person been executed the splatter would have been at a lower angle.
