If however they find not-deleted stuff, they may forensically examine your reformatted hard drive for traces of context. But it will be hard for them to fully resurrect an image of a reformatted hard drive.

What I said is that the files are legally not there(in some law systems), but the traces of deleted files will show that the files exist before.
The criminal law says the possession of certain files is illegal, and hence the fact that a man deleted the files doesn't change the fact that he already broke the law before (no time limit for criminal law charges, once you broke the law, you can be charged, no mattet what compensation you do).
