The south didn't agree, and ideological differences arose, giving reason for them to want to secede, and thus giving reason for the civil war.
It was not, like most people assume, started because the northerners were the good progressive equal rights activists of the past, but rather the southern states not wanting to be a part of the union anymore because of ideological and political differences, which was a no-no.

Given unlimited time and all resources needed allocated to the war the US will win without question. If the US military's equipment is from the current day and age the Vietcong would be decimated in any engagement between the two opposing combatants. What with our modern intelligence systems, HD satellite/recon plane or drone imaging, and computer systems used to predict opposition movements and objectives it would be next to impossible for the VC to evade the US indefinitely. These aspects coupled with modern weapon technology such as smart missiles and bombs, smart high caliber munitions, and hardier more specialize-able weapons (Most small arms platforms are modular and attachments/specific parts can be changed to better suit the environment) would significantly reduce the VC's ability to engage US soldiers and gain and/or sustain any combat advantage(position, firepower, stealth, ect.). Not to mention modern aircraft and naval units the US has developed since the Vietnam conflict which are exponentially more effective and advanced than their predecessors. And lastly more modern and provenly more effective basic training for soldiers and officers, and vastly superior, cohesive, and effective special Ops units. Not to mention the shear increase in their numbers and funding. Its is very safe to say that the US military would win on most, if not all fronts of the conflict, while sustaining less than moderate casualties.

Probably because gun laws are nonexistent on the federal level, so there's nothing to enforce? Perhaps? It really is a state by state basis and that causes huge problems. Even though New York has tough gun laws and is nearly impossible to get a license there, you can go to Virginia, go to a gun show and drive back up to NY.
