I disagree with your assertion that a police state would necessarily just shoot someone for contesting them. They don't have to shoot the person if they know in advance that the courts will side with them, because the laws have all been written in their favor. And until very recently, that is what has happened. Local police departments had no check on them because the courts would always rule in their favor. No shooting necessary.
