What you're missing is the 9th and 10th amendments. The 9th amendment states that the rights of the people are more than what was listed before this so things like drug prohibition and bans on prostitution aren't just ineffective and harmful, but they're also not really allowed by the constitution. The other relevant amendment is the 10th. It says that all government responsibilities not listed in the constitution are the powers of the states where the federal government's jobs are regulating interstate trade, federal funding (a loophole, this by giving the states funding for their highways the federal government was able to set the national drinking age at 21), and as a check against the states to protect the rights of the people.

The constitution is supposed to be a breathing document, even Jefferson had a quote to that effect. Also, the Supreme Court as it is today wasn't outlined in the constitution. The process of judicial review was instituted by John Marshall in 1801 in the case Marbury v Madison. Basically, what happened was John Adams (president 1797 - 1801) appointed a judge (justice of the peace in DC) right as he was leaving office (called midnight judge) but the appointment was not delivered (James Madison, secretary of state at the time) was supposed to deliver it, but waited a day or two. So Marbury (the guy who was nominated) sued Madison over this. John Marshall (chief justice of the Supreme Court until like 1828 or something, lol) used this opportunity to his advantage. The case was Marbury v Madison and the court ended up saying Madison's actions were illegal, but he wasn't obligated to remedy the situation (basically, nothing happens), but Marshall also tacked on the process of judicial review (knowing that Jefferson would go with it because Marshall effectively sided with him). As a result, the Supreme Court taking on cases and reviewing the constitutionality of actions/laws was established.
