Firstly, the simple act of setting up a private server is enough to warrant jail time. It is clearly a move to circumvent freedom of information act requests which in and of itself is enough to put you in jail. There are 6 such servers. This is a MINIMUM of thousands of counts of mishandling of government documents, interfering with a federal investigation, and violation of tons of acts like Sarbanes-Oxley that I'm not even sure what they're called because I'm not a lawyer.
Secondly, the guy who setup the server, who was a contractor, did not even have DoD clearance. So, SOMEONE in the organization (her or someone directly under her, which is one of 4 other people) gave him their DoD access to perform the migration. That is fines, jail time, revoking of your clearance, and can no longer hold public office of any kind.
All of this has been ALREADY established WITHOUT the grand jury trial and other people surrounding her have already be indicted for the exact same kind of shit (using their phone/gmail accounts etc) instead of .gov accounts and have publicly stated that she should be put on trial for this and is being treated fairly.
The only foreseeable issue is that it will be fucking sealed in grand jury for 15 years and she'll be dead by then.

That's not even what they're prosecuting her for. They're prosecuting for violations of the Freedom of Information Act and for using the Clinton Foundation as a way to funnel money.
Using her foundation (which may I add has already been investigated because of fraud) she can use her clearance to accept bribes. I have worked with companies that have to comply with Sarbaines-Oxley though and it's shitloads more stringent that what she did with her server. That requires you to archive all email before it gets to the users inbox in a separate database and archive that information for 7 years. If you handle financial data for other businesses you're required to comply with that act.
Her fund would be required to comply with sarbaines-oxley making it illegal for her to delete the "private" emails and I'm well certain that there are far more stringent requirements than that for a .gov account.
The government contractors I support have to send their emails using TLS, with a digital signature and only from specific computers/phones. They also have to archive for "the length of the contract" which for some can be 30 years.

If something is classified, it just is. You don't have to like stamp it classified. This is the problem with her in particular. The act of her office touching a document has a tendency to MAKE it classified. She knows that. That is WHY she setup the server.
